Openness and Retain Links

Today adoption is an open process; the implications of this remain significant throughout the lives of all involved.  Children who are adopted have a right to knowledge about their birth family and to the reasons why they were adopted.  Nugent Care recognises the continuous importance of past events and relationships to the overall well-being of the child or young adult.

Evidence from research and from adopted people themselves indicates that the adopted child needs as much information as possible about their birth family and, in some cases, to maintain links with some members.  In this way a child develops a realistic understanding of the circumstances which led to separation from their birth family and subsequent adoption.

How links are maintained is always based on the needs of the child and the ability of the birth family to participate in a way which is positive for the child.  Maintaining links always focuses on the long term well-being and security of the child as a member of his/her adoptive family and should never compromise their ability to form attachments and identify with them.

Individual plans for maintaining links are always developed before a child is matched with adopters so that you would be fully informed and agreeable before committing yourself to a child.

There are many ways links can be maintained, from a letterbox arrangement, where written information is exchanged via a third party - usually an adoption agency - through keeping in regular contact with the people who permanently care for a child’s birth siblings and occasionally through meeting with birth parents at regular, although infrequent, intervals.

Inter-Country Adoption Support

Many local council adoption services choose to contract out their duty to provide an Intercountry Adoption Service to a voluntary agency such as Nugent Care.  In the North West of England the 22 Local Authorities comprising Greater Manchester, Merseyside, Lancashire and Cumbria have chosen to do this and so you have a choice of 2 voluntary adoption agencies, Nugent Care or Adoption Matters NW.  If you choose Nugent Care then we can support you through the process of adoption by helping you in your preparation to adopt.  We can support and advise you in your decisions about the age, race, culture, and health of the child(ren) you feel comfortable adopting.  All adoptive parents have a picture in their mind of their child or children; Nugent Care Adoption Service is here to help you with those decisions.

Each Intercountry Adoption has its own individual or specific requirements which will include the Prospective Adopter Criteria requirement of the Country from which you choose to adopt. We are here to help you meet those challenges so that your adoption process can move along smoothly.

Post Adoption

Your local council Adoption service has a duty to assess your family for post adoption support services, should you need to request such support.  This is a requirement of the Adoption and Children Act 2006.

We provide lifelong interpersonal support, as requested or required, for all those who have adopted from abroad and who were approved by Nugent Care, and also for their adopted children.

We may provide advice, support and mediation services to birth relatives looking for those previously placed for adoption with adopters approved by our agency.

Some countries require post adoption reports to be sent to their Central Adoption Authority for a period following the adoption.  To comply with current UK legislation, these reports must be completed by a qualified and accredited social worker.  If your adoption was completed in a country who is a signatory to the Hague Convention, or is a ‘designated’ country, then your local authority may choose not to do these reports.  Nugent Care will provide these reports, if you contract us, but there will be a fee for this service.

If you adopt a child from a country that is NOT a signatory to the Hague Convention, then you will have to adopt your child again when you return to the UK.  Your local council Adoption service has a statutory duty to supervise your child in placement with you until an Adoption Order is granted in a UK court.  Some local council’s will contract this work out to Nugent Care who will support you through this process.

Our Post Adoption service is managed by a professionally qualified Service Manager and staffed with experienced Adoption Practitioners.

ARE YOU AN ADOPTED PERSON, AN ADOPTIVE PARENT OR A BIRTH RELATIVE?  IF SO, THE FOLLOWING MAY AFFECT YOU.

Section 98 of the Adoption and Children Act 2002 came into force on December 30th 2005. It introduced a new statutory requirement for all Adoption Agencies like Nugent Care Adoption Services, to offer a service to birth relatives who wish to have news of, or establish contact with, a child they placed for adoption.

The new legislation now requires us to make this service available once the adopted person has reached the age of 18.  It also includes those children who were adopted from abroad.

No identifying information can be given to the birth relative, and any contact with the adopted person would be via post adoption workers from Nugent Care Adoption Service, following in depth exploration with the birth relative about their wishes and expectations.

The Intermediary Service for adopted adults remains the same, in that any adoptee over the age of 18 can receive support in tracing their birth family from their Adoption Agency, having first had access to the background records we hold.

The new legislation also introduces the facility for adoptees and birth relatives to register a Wish for Contact, No Contact or to place a Veto Against Any Contact.

Children Available for Adoption

Adopting a child from another country may be referred to as:
‘Inter-country’ adoption
‘Overseas’ adoption
‘Adopting from abroad’.

Nugent Care Adoption Service and Adoption Matters Northwest work in partnership with Adoption 22 (the 22 North West Local authorities) to offer initial information and advice.

Inter-country Adoption, as with domestic adoption, is there to meet the needs of children. Nugent Care Adoption Service seeks families to meet the needs of children but the child’s needs will be the paramount consideration.

The principles of Inter-country Adoption which are enshrined in the relevant international conventions to which the UK are a signatory are as follows:

  • Children who cannot live with their birth parents should be given the opportunity to live as part of a permanent family in their country of birth wherever possible;
  • Inter-country adoption may be considered as an alternative means of providing a permanent family for a child who has been abandoned or lost and who cannot be cared for in a suitable manner in his or her own country of origin;
  • Inter-country adoption should only take place where it is in the best interests of the child and with respect for his or her fundamental rights;
  • Safeguards and standards equivalent to those which apply in domestic adoption should be applied in inter-country adoption to protect the welfare of the child;
  • Inter-country adoption should only take place after the birth mother has given her informed consent to adoption AFTER the birth of her child;
  • Profit should not be made from the process.

After speaking to an Adoption Practitioner and having received and considered the written information we provide you may wish to continue with your desire to adopt from overseas in which case you will need to ensure that you research the requirements of the country you are considering adopting from and establish that you meet their criteria. You will also need to meet the criteria for adoption under UK law. We will offer assistance with this decision as we believe it is important that you are making an informed choice.

Nugent Care Adoption Service would also recommend that you seek independent legal advice to ensure your eligibility.

The Adoption Process

The process of assessment for approval as a prospective adopter for a child from overseas is the same as it is for domestic adoption.

Following approval the paperwork is sent to the Dept for Children, Schools & Families (DCSF) and Nugent Care only remains involved as an advisory body until matching has taken place. Nugent Care does not have any involvement in liaising with the placing country and has no influence in controlling timescales or linking matters.

Following the matching process, which will vary dependent on the country, Nugent Care will be required to discuss the match and confirm your decision to proceed.

On your return to the UK with the child Nugent Care may have some involvement with regards post placement reports. Dependent on the country, it may be a requirement for you to apply for an Adoption Order under UK law, and if this is the case then statutory supervision will be carried out either by the Local Authority or they can commission Nugent Care.

Following the making of an Adoption Order, whether it is in the country of origin or in Britain, Nugent Care will offer the same level of support as given to domestic adopters. est laborum.
